Throughout these terms, “Patch Cellar”, “we”, “us” and “our” refer to Phil Smith trading as Combat Cellar.
2. These terms
These Terms and Conditions apply when you use patchcellar.co.uk or place an order through the website.
By placing an order, you confirm that you accept these terms. Nothing in these terms affects your statutory rights under UK consumer law.
3. Products
We make reasonable efforts to display product descriptions, measurements and colours accurately. Colours may appear slightly different depending on your screen and device settings.
Unless stated otherwise, sizes are approximate.
Products are subject to availability. We may withdraw or change products without notice, but this will not affect orders we have already accepted.
4. Orders
After placing an order, you will receive an email acknowledging that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
A contract is formed when we confirm that your order has been accepted or dispatched.
We may refuse or cancel an order if:
- The product is unavailable.
- The price or product information contained an obvious error.
- Payment cannot be authorised.
- We reasonably suspect fraud or misuse of a promotion.
- We cannot deliver to the address provided.
If payment has already been taken for a cancelled order, we will issue a refund.
5. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable.
Delivery charges, if any, will be displayed before you complete checkout.
Payment must be made using one of the payment methods available at checkout. Orders will not be dispatched until payment has been authorised.
6. Promotions
Promotions are subject to their stated terms and availability.
For the Buy 2, Get 1 Free promotion, customers must add three qualifying patches to their basket. The cheapest qualifying patch will be free. The offer includes Premium patches unless stated otherwise.
Promotions cannot be exchanged for cash and cannot normally be combined with another promotion unless we state otherwise.
If products purchased as part of a promotion are returned, any refund will be adjusted to reflect the discount received and the products retained.
7. Delivery
We aim to dispatch orders within two to three working days unless a different timeframe is displayed on the product page.
Estimated delivery dates are not guaranteed. We are not responsible for delays outside our reasonable control, but we will contact you if a significant delay becomes known.
Orders will be delivered to the address entered at checkout. Customers are responsible for checking that the delivery address is complete and accurate before submitting an order.
Unless a different timeframe has been agreed, goods will be delivered within 30 days of the order being accepted.
8. Cancellation and change-of-mind returns
For standard, non-personalised products purchased online, you may cancel your order without giving a reason from the time the order is placed until 14 days after the goods are delivered.
You must tell us clearly that you wish to cancel by emailing info@patchcellar.co.uk or using the cancellation form at the end of our Returns and Refunds Policy.
After notifying us, you have a further 14 days to return the goods.
Customers are responsible for the cost of returning change-of-mind items. We recommend obtaining proof of postage.
Further information is provided in our Returns and Refunds Policy.
9. Custom and personalised products
The statutory right to cancel for a change of mind does not normally apply to goods that are made to the customer’s specifications or clearly personalised.
This includes custom patches made using customer-supplied wording, artwork, logos, colours or other individual requirements.
Customers remain entitled to a remedy if a custom or personalised product is faulty, damaged, not as described or does not match the approved design.
Where we provide a design proof, the customer is responsible for checking all wording, spelling, colours, dimensions and design details before approving production.
10. Faulty, damaged or incorrect goods
Customers have legal rights when goods are faulty, damaged, not as described or unfit for their intended purpose.
Please contact info@patchcellar.co.uk as soon as possible and include your order number, a description of the problem and photographs where helpful.
Where goods are confirmed as faulty, damaged or incorrect, we will provide an appropriate repair, replacement, price reduction or refund in accordance with UK consumer law. We will cover reasonable return costs where we ask for the goods to be returned.
11. Refunds
Approved refunds will be made to the original payment method.
For a valid cancellation of an entire order, we will refund the price paid and the cost of standard delivery. Any additional amount paid for an enhanced delivery service is not refundable beyond the cost of standard delivery.
We may reduce a change-of-mind refund if returned goods have been handled beyond what would reasonably be permitted when examining them in a shop.
Full details are provided in our Returns and Refunds Policy.
12. Intellectual property
Unless stated otherwise, the content of this website—including text, graphics, branding, photographs and original designs—is owned by or licensed to Patch Cellar and may not be reproduced without permission.
Customers ordering custom products confirm that they have permission to use any artwork, wording, trademarks or logos they provide. The customer is responsible for claims resulting from unauthorised material they supply.
13. Liability
We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of statutory consumer rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products are supplied for personal use unless agreed otherwise. We are not responsible for business losses arising from consumer purchases.
14. Privacy
Personal information is processed in accordance with our Privacy Policy.
15. Changes to these terms
We may update these terms occasionally. The terms applying to an order are those published when the order was placed.
16. Governing law
These terms are governed by the laws of England and Wales.
Consumers living elsewhere in the United Kingdom retain any mandatory rights and may bring proceedings in the courts applicable to where they live.
